§ 10-28. Location restrictions.

  • (a)

    Adult entertainment establishments are permitted only within the following geographical area of the city: That area bounded on the north by Medical Way, on the east by Roy Huie Road, on the south by Upper Riverdale Road and on the west by River Park Drive.

    (b)

    No adult entertainment establishments shall be located:

    (1)

    Within 1,500 feet of any parcel of land which is either designated for or used for residential uses or purposes;

    (2)

    Within 1,500 feet of any parcel of land upon which a church, school building, school grounds, college campus, public place of worship, governmental building, library, civic center, public park or playground, hospital, child care center or nursing home is located;

    (3)

    Within 1,500 feet of any parcel of land upon which another establishment regulated or defined under this article is located;

    (4)

    Within 1,500 feet of any parcel of land upon which alcoholic beverages are sold or dispensed;

    (5)

    On a lot comprising less than three acres of land containing less than 300 feet of road frontage;

    (6)

    Closer than 40 feet from the building and structures of any other business establishment;

    (7)

    Within a strip shopping center, mall, other group structures or any other place in which it does not have a separate building of its own; or

    (8)

    Within the Central Business District.

    (c)

    For the purposes of this section, distance shall be measured from the closest property line on which the adult entertainment enterprise is located to the closest property line on which the other identified property is located.

    (d)

    No further licenses for an adult entertainment establishment shall be issued when the total number of licenses for such establishments, issued and in effect, would number more than one for each 5,000 persons residing in the city as established by the most recent decennial census.
