§ 26-22. Compliance with state and federal laws.

  • (a)

    A grantee shall, at all times, comply with all laws and regulations of the state and federal governments or any administrative agency thereof, and if any state or federal law or regulation shall require a grantee to perform any service or shall prohibit a grantee from performing any service or shall permit a grantee to perform any service in conflict with the terms of the franchise or of any law or regulation of the city, then as soon as possible following knowledge thereof, a grantee shall notify the administrative officer of the point of conflict believed to exist between such regulation of law and the laws or regulations of the city or the franchise, and a grantee shall be governed by the advice of the administrative officer.

    (b)

    Grantee shall be subject to all city ordinances as set forth in this chapter, and grantee shall also be subject to all applicable rules and regulations which, from time to time, may be promulgated by the FCC for CATV systems.

    (c)

    If the governing body determines that a material provision of this chapter is affected by such subsequent action, the governing body shall have the right to modify any of the provisions in this chapter to such reasonable extent as may be necessary to carry out the full intent and purpose of this chapter.
