§ 26-8. Indemnity.

Grantee shall at its sole cost and expense fully indemnify, defend and save harmless the city, its officers, boards, commissions and employees against any land and all claims, suits, actions, liability and judgments for damage.
(1)

These damages or penalties shall include but shall not be limited to damages arising out of copyright infringement and all other damages arising out of the installation, operation or maintenance of the CATV system authorized herein, whether or not any act or omission complained of is authorized, allowed or prohibited by the franchise.

(2)

A grantee shall pay and by its acceptance of the franchise specifically agrees that it will pay all expenses incurred by the city in defending itself with regard to all damages and penalties mentioned in subsection (1) of this section. These expenses shall include but not be limited to all out-of-pocket expenses such as attorney fees and all other costs of litigation.
