§ 2-58. Powers; duties; bond.

  • Subject to the control, direction and supervision of the city council, the city manager shall have power, and it shall be his duty, to:

    (1)

    See that all laws and ordinances and the provisions of the City Charter are enforced.

    (2)

    See that the business and affairs of the city are efficiently organized and handled.

    (3)

    Exercise administrative control over all regular departments and divisions of the city; provided the city manager shall not have or exercise any control over the planning and zoning commission, board of zoning appeals, recreation commission or other special board, commission, committee, authority or body set up under any general law or any ordinance or agreement of the city council.

    (4)

    Be the personnel director and have the power to appoint and remove all officers, department heads and employees in the respective offices and departments except the city attorney; provided, however, that he shall be guided in his actions by the city merit rules and regulations. Nothing herein shall prevent the city council from creating, abolishing, consolidating, altering or modifying departments.

    (5)

    Attend the meetings of the city council, with the right to take part in all discussions, but have no vote.

    (6)

    Recommend to the city council for adoption such measures as he may deem necessary or expedient.

    (7)

    Prepare and submit to the city council an annual budget.

    (8)

    Keep the city council fully advised as to the financial condition and needs of the city.

    (9)

    Make and execute all lawful contracts on behalf of the city as to matters within his jurisdiction, except such as may be otherwise provided by law or by ordinance or resolution of the city council; provided, no contract, including installment contracts, purchase or obligation involving more than $4,999.00 total shall be valid or binding until approved by the city council; and provided further, without approval of the city council neither the city manager nor other officer or employee shall in any calendar month expend or obligate for any purpose any sums in excess of the monthly budget, or one-twelfth of the annual budget therefor, as fixed by the city council.

    (10)

    Submit to the city council such reports as he may deem necessary or as may be required of him by the city council.

    (11)

    Perform such other duties as may be required by ordinance or resolution of the city council.

    (12)

    Give bond in the penal sum fixed by the city council with surety approved by the city council, payable to the city and its successors and assigns, for the benefits of the city and for the use and benefit of the public to secure and indemnify the city and all of the public, by reason of his default, misfeasance, malfeasance and/or nonfeasance in the performance of his duties. The premium of such bond shall be paid by the city.
