§ 42-34. Duty to maintain sidewalks.

  • (a)

    Duty to keep sidewalks clean. It shall be the duty of all occupants and owners of property, both occupied and vacant, in which the property abuts a paved or unpaved sidewalk, to keep that sidewalk area and the adjacent right-of-way clean and to do such sweeping, scraping, cutting of grass or weeds, watering, pruning and maintaining planted material and removing clay, dirt and trash as may be necessary to render it passable, comfortable and sightly.

    (b)

    Duty to remove snow and ice. When there is an accumulation of ice or snow, naturally or by artificial means, sufficient to accumulate on the sidewalks, it shall be the duty of all occupants and owners of property, both occupied and vacant, in which the property abuts a paved or unpaved sidewalk, to clear ice and/or snow from the sidewalks within 12 hours from the time such snow or ice ceases to fall, or within less time if so ordered by the city.

    (c)

    Duty to repair and/or repave sidewalks.

    (1)

    When the sidewalk abutting the property is damaged or otherwise in need of repair, it is the obligation of the abutting property owner to repair and/or repave such sidewalk upon notice from the city. If after receiving such notice, the abutting property owner fails to complete the repairs and/or repaving of the sidewalk within 60 days, the city is authorized to make such repairs and assess the abutting property owner for costs incurred.

    (2)

    Permit required. It shall be unlawful for any person to construct, repair or repave any sidewalk without first having obtained a permit from the community development department. If any person, without first obtaining the permit, should construct, repair or repave a sidewalk, then the person shall be in violation of this section, and the city shall be authorized to condemn the sidewalk, have it removed and have it replaced at the expense of the owner of the property, the owner being notified of this action prior to construction.

    (3)

    Standards for sidewalk construction, repair and/or repaving. When construction, repair or repaving of the sidewalk is deemed necessary by the city, the sidewalk shall be constructed, repaired or repaved with hexagonal pavers or a standard sidewalk inlaid with an 18-inch diameter hexagonal imprint. All such sidewalks shall be constructed in accordance with the plans and specifications approved during the city's mandatory permit process.
