§ 42-36. Notification of violation.

  • (a)

    Whenever it appears that any provision of this article is being violated, a code enforcement officer shall notify the responsible person(s) of the alleged violation(s). Such notice shall specify the violation involved, the corrective action needed and the time frame for completion of the corrective action.

    (b)

    Notice shall be by personal service or by certified mail. Any time period provided in this section shall be deemed to commence on the date of the receipt of the notice. If the current whereabouts of the responsible person(s) are unknown or if service by certified mail cannot be effected, notice shall be mailed by first-class mail to such person's last known address, if any, and a copy of the notice shall be posted on the premises.

    (c)

    Should an individual or business be found in violation of the same provision(s) of this article within any 12-month period, notwithstanding the requirements of this section, a citation may be issued immediately, without any time allowed for corrective action.
