§ 62-2. Definitions.
Backdoor service means service provided at no additional charge to persons with a disability and no able-bodied person in the household.
Bags means plastic or paper sacks designed to refuse with sufficient wall strength to maintain physical integrity when lifted by top. Total weight of a bag and its contents shall not exceed 50 pounds.
Bulky waste means stoves, certified CFC free refrigerators, CFC free air conditioning units, hot water tanks, washing machines, furniture, and other waste materials other than construction debris, hazardous waste, or auto parts with weights or volumes greater than those allowed for carts or bags.
Cart means a 95-gallon roll receptacle, with wheels and lid, designed for the purpose of curbside collection of refuse.
City means the City of Riverdale, Georgia
Commercial and industrial refuse means all garbage and rubbish generated by a producer at a commercial and industrial unit, but in all cases to exclude hazardous waste.
Commercial and industrial unit means all premises, locations or entities, public or private requiring refuse collection within the service area for which refuse collection using dumpsters, compactors, roll offs, top loaders and carts is deemed to be appropriate, other than a residential unit.
Construction debris means waste building materials resulting from construction, remodeling, repair or demolition operations.
Contractor means the person, corporation or partnership performing refuse collection and disposal, under contract with the city.
Control means the possession, directly/indirectly, of the power to director cause the direction of the management and policies of a person or entity, whether through ownership of voting securities, by entreat, or otherwise.
Disposal site means a refuse depository including but not limited to sanitary landfills, transfer stations and waste processing separation centers licensed, permitted or approved by all governmental bodies and agencies having jurisdiction and requiring such licenses, permits or approvals to receive refuse for processing or final disposal.
Dumpster means metal receptacles, with a well fitted lid, designed to be lifted and emptied mechanically for use primarily for commercial and industrial refuse.
Drop-off carts means containers to be placed at multi-family and condominium units for collecting recyclable materials from producers therein.
Garbage means every accumulation of waste (animal, vegetable and/or other matter) that results from the preparation, processing, consumption, dealing in, handling, packing, canning, storage, transportation, decay or decomposition of meats, fish, fowl, birds, fruits, grains or other animal or vegetable matter (including, but not by way of limitation, used tin cans and other food containers; or easily decomposable animal of vegetable waste matter which is likely to attract flies or rodents); except (in all cases) any matter included in the definition of construction debris, hazardous waste, yard trimmings, or rubbish.
Hazardous waste means waste, in any amount, which is defined, characterized or designated as hazardous by the United States Environmental Protection Agency or appropriate state agency by or pursuant to federal or state law, or waste, in any amount, which is regulated under federal or state law. For purposes of this chapter, the term hazardous waste shall also include motor oil, gasoline, paint, paint cans and items containing Freon or chlorofluorocarbons.
Multi-family unit means individual residential units in a multi-family structure (i.e. apartment building) which units are not separately owned by are owned by one common entity, for which refuse collection using dumpsters and recycling using drop-off carts, is deemed appropriate. For the purposes of this chapter, all multi-family units will be deemed "commercial and industrial units," and all applicable provisions shall apply accordingly.
Producer means an occupant of a residential unit or commercial and/or industrial unit who generates refuse and/or recyclable materials.
Recyclable material(s) means corrugated cardboard, chipboard, office paper, computer paper, colored paper, newsprint, magazines, glass bottles and jars (green, brown, clear) aluminum and bi-metal cans; HDPE clear plastic milk jugs and PET plastic soft drink containers and (used motor oil containers); or any other commodity agreed upon in writing by the city and vendor.
Recycling waste bin means a receptacle with a capacity of 18 gallons made of plastic and designed for the purpose of residential curbside collection of recyclable materials.
Recycling waste cart means a receptacle with a capacity of 65 gallons made of plastic and designed for the purpose of commercial collection of recyclable materials.
Refuse means all garbage and/or rubbish and/or bulky waste and/or yard waste generated by producers.
Residential unit means (a) a free standing dwelling within the corporate limits of the city occupied by a person or group of persons: and (b) a residential unit contained in a building consisting of not more than four such units, and for which Refuse collection service using carts is appropriate, as determined by the city. A residential unit shall be deemed occupied when either water or domestic light and power services are being supplied thereto.
Rubbish means all chips, shavings, sawdust, printer matter, paper, pasteboard, rags, straw, used and discarded clothing, shoes and boots, combustible waste pulp and other products such as are used for packaging, or wrapping crockery and glass, ashes, cinders, floor sweepings, glass, mineral or metallic substances, and any and all other similar waste materials not included in the definition of construction debris, garbage, or hazardous waste.
Service area means the entire geographic area within the corporate limits of the city, unless otherwise agreed to by the parties in writing.
Unacceptable waste means highly flammable substances, hazardous waste (as defined herein), liquid waste, special waste, certain pathological and biological waste, explosives, toxic materials, radioactive materials, material that the disposal facility is not authorized to receive and/or dispose of, and other materials deemed by state, federal or local law, or in the reasonable discretion of vendor, to be dangerous or threatening to health or the environment, or which cannot be legally accepted.
Yard waste means all tree trimmings, dead plants, weeds, leaves, and dead tree debris not exceeding four feet in length, four inches in diameter or forty pounds. In addition, yard waste shall include Christmas trees, of any length, diameter or weight.
Yard waste bags means biodegradable paper bags especially made to dispose of yard waste.
