§ 69-11. Exceptions to CUP requirement.

  • (a)

    A CUP shall not be required to erect, install or maintain an antenna on or upon an existing tower or monopole that has been previously properly permitted by the city. However a building permit shall be required prior to installation in such circumstances.

    (b)

    A single antenna under 70 feet in height owned and operated by a federally licensed amateur radio station operator shall be excepted from the CUP provisions of this chapter. The owner or operator of such antenna, however, shall be required to comply with all applicable city, state and federal codes.

    (c)

    Towers and monopoles located on governmentally owned or controlled property shall be excepted from the CUP provisions of this chapter, provided that prior to placement, the city may require the submission of an application containing the information required by this chapter for applicants placing structures on private property. For the purposes of this section, governmentally owned or controlled property shall include city, county, state, authority, board of education or federal property.

    (d)

    This article shall not apply to the installation, maintenance, or use of:

    (1)

    A satellite earth station antenna that is two meters or less in diameter and is located or proposed to be located in any area where commercial or industrial uses are generally permitted;

    (2)

    A satellite earth station antenna that is one meter or less located or proposed to be located in any area; and

    (3)

    Residential antennas and dishes.
