§ 57. Draining or filling of lots or cellars.

  • Be it further enacted, that said mayor and councilmen shall have full power and authority to cause owners of city lots, and cellars, if same should be a nuisance, or a board of health should recommend that said lot or cellars, be filled or drained, to cause the owners to fill or drain said lots, or cellars, to the level of the streets or alleys upon which said lot or cellars are located. That if the owners or occupants of the lots or cellars shall fail or refuse after notice, either to themselves or to their agents, as the mayor and councilmen may elect, to comply with the requirement of said mayor and councilmen, by draining or filling said lots or cellars, it shall be lawful for said mayor and councilmen to have this work performed and the amount of money so expended in doing so collected by executions, and the sale under such execution shall pass the title to the property.
