§ 42-32. Definitions.

  • For the purpose of this article the following terms shall have the meanings respectively ascribed to them:

    Accessory building means a carport, attached or detached garage, storage building or any other building not intended for habitation located on the premises.

    Derelict boat or derelict trailer-type vehicle means a boat or trailer-type vehicle which:

    (1)

    Is dismantled, partially dismantled, deteriorated or not safe for use due to disrepair or damage; and

    (2)

    Which constitutes a nuisance or health or safety hazard in that it provides a place for insects, rodents or other animals to exist, attracts children, vagrants or other individuals or may cause injury to persons.

    Derelict vehicle is a vehicle which:

    (1)

    Is unusable due to disrepair because one or more of the major parts needed for its operation has been removed, damaged or destroyed or has been made not safe for operation through disrepair or damage; and

    (2)

    Which constitutes a nuisance or health or safety hazard in that it provides a place for insects, rodents or other animals to exist, attracts children, vagrants or other individuals or may cause injury to persons.

    Established driveway means an area that is covered by gravel, asphalt, concrete or other paving material commonly recognized in the paving industry and is clearly indicative of an area that is normally used for vehicles to enter onto, drive over or exit from real property from or to a public or private street.

    Established parking lot means an area that is paved or graveled and clearly discernible as an area which is reserved for the parking of vehicles on private property and associated with the primary use of such property.

    Front yard means the yard extending across the front of the lot between the side yard lines and being the minimum horizontal distance between the street line and the main building or any projections thereof, other than the projections of uncovered steps, uncovered balconies and uncovered porches. If there is no building on the property, the entire property shall be deemed the front yard. The right-of-way is included in the definition of "front yard" for purposes of this article.

    Inoperable vehicle means a vehicle, or any part thereof, including vehicle trash and debris, which cannot be driven upon the public streets for reasons including, but not limited to, being unlicensed, wrecked, abandoned, in a state of disrepair or incapable of being moved under its own power.

    Junk material means any item that is unsightly and has no significant value in its present form, including but not limited to: Inoperable machinery and equipment; appliances and other household items; abandoned tires; and other such unsightly accumulations of debris.

    Person means any natural person, corporation, partnership, authority created by statute, association or other entity or combination thereof.

    Right-of-way means that real property, titled in the city or held in perpetual easement for street-related purposes, lying between the edge of the paved or unpaved street and the adjoining property boundary with private property. The term shall encompass all areas adjoining the public street or roadway wherein utilities and sidewalks are located and maintained.

    To place means to establish the presence on property of an object which:

    (1)

    Is capable of being moved or removed and which is not affixed to the real property; and

    (2)

    Is present on the property for a period of at least one day, whether or not the location of the item on the property is changed.

    Vehicle means an automobile, truck, van or other motor vehicle designed and intended for use in transporting people and/or goods.
