§ 74-120. Fi. fas.; issuance where transferred assessments over specified age; notice; interest; docketing; collection.

  • (a)

    Issuance, notice. When any of the assessments so transferred are at the time of transfer four years or more old, or thereafter become four years or more old, the city shall issue or cause to be issued fi. fas. for the assessments. However, it shall notify the owner of the property so assessed for sewers by mail at least 20 days prior to the issuance of execution in order to afford the owner an opportunity of paying the assessment and saving further charges thereof. The assessment as described in section 74-119 may be held by the city clerk until the time for the issuance of executions as herein provided.

    (b)

    Interest. The executions of fi. fas. shall include interest at the rate of 12 percent per annum from the date of the assessment until the date of the issuance of the fi. fas.

    (c)

    Docketing. It shall be the duty of the city clerk to cause all of the executions to be promptly entered upon the general execution docket of the county.

    (d)

    Collection. The procedure for the collection of these fi. fas., after they have been issued and recorded, shall be the same as other executions for taxes and public improvements.
