§ 62-26. Commercial and multi-family collection—Rules governing owners and occupants.

  • (a)

    All owners and occupants of commercial and industrial property and all owners of multi-family property shall be responsible for:

    (1)

    The collection and transportation of all refuse accumulated at such place as set forth in sections 62-28—62-30; and;

    (2)

    Preventing overflow of refuse from containers or other nuisance-causing conditions. No occupation tax permit or renewal thereof shall be issued to the owner or occupant of commercial and industrial property or owner of multi-family property until such person has arranged for adequate refuse collection for the property in compliance with sections 62-28—62-30. No occupation tax permit or renewal thereof shall be issued to the owner or occupant of commercial and industrial property or owner of multi-family property that has outstanding payments due for commercial sanitation services or related fees.

    (b)

    All owners and occupants of commercial and industrial property and all owners of multi-family property shall be responsible for procuring adequate refuse receptacles (i.e. dumpsters, bulk containers or similar) in good condition for use by the property. Such refuse receptacles must meet the conditions set forth in sections 62-31 and 62-32 below.

    (c)

    All owners and occupants of commercial and industrial property and all owners of multi-family property shall maintain the area immediately surrounding the refuse receptacles free of unsightly refuse at all times, ensuring that all refuse is placed completely within the receptacle with all doors and lids to be closed at all times the receptacle is not being loaded or emptied. Said persons shall maintain the refuse receptacles in good condition. All owners and occupants of commercial and industrial property and all owners of multi-family property shall be responsible for the cost of repair or replacement of any refuse receptacles damaged by abuse, fire, theft, negligence or other cause of damage.
