§ 66-30. Restoration and repair.
(a)
General obligations.
(1)
When any part of said street, sidewalk, alley or other public place of the city shall be torn or dug up for any purpose, the person making that excavation or opening shall have the duty, within ten days of refilling the excavation or opening so as to restore it to essentially the same condition that existed prior to the excavation or opening. The cost for the restoration and repair shall be paid by the person making or causing such excavation.
(2)
The permit holder must notify the community development department in writing of the completion of the restoration and repair work.
(3)
Any person neglecting, refusing or failing to comply with any provisions of this section shall be guilty of a violation. Each day such failure continues shall constitute a separate offense.
(b)
Specifications for repair of residential roadway. Any street opening on a residential road shall be filled with crusher run stone and tamped every six inches until the hole is filled within four inches of finished grade. At this point the existing pavement will be cut back four inches all around the hole to undisturbed roadbed, and four inches of new asphalt will be installed and compacted with roller in two-inch lifts unless the city deems the repair needs to be put to heavily traveled specifications, in which case the specifics of section (c) shall apply.
(c)
Specifications for repair of nonresidential roadway. Heavily traveled, commercial and industrial roads shall be filled with crusher run stone and tamped every six inches until hole is filled within eight inches from finished grade. The existing pavement will be cut back four inches all around the hole to undisturbed road bed then filled with six inches of 4,000 pound concrete reinforced with fibermesh. After 24 hours, final two inches shall be installed with blacktop and compacted with roller. Permit holder shall place and maintain traffic plates over repair until completed.
(d)
Warranty. All road repairs shall have a one-year warranty. The security set forth in section 66-29 shall be kept current until the expiration of the one-year warranty time period.
